§ Designated Copyright Agent
Notices of claimed copyright infringement on Sceenz should be sent to our Designated Agent. To be effective under the DMCA, a notice must include the elements listed in the next section.
The Designated Agent is reachable only for copyright matters. Other support, abuse, or business inquiries sent to this address may not receive a response.
§ Filing a Takedown Notice
If you are a copyright owner (or authorized to act on behalf of one) and you believe that material on Sceenz infringes your copyright, please email our Designated Agent at legal@sceenz.net with all of the following. Notices that omit any of these items may be ineffective under the DMCA and may delay or prevent action.
- Your signature — a physical or electronic signature of the copyright owner, or of a person authorized to act on their behalf.
- Identification of the copyrighted work — a description of the work claimed to have been infringed, with enough detail for us to identify it. If you are reporting multiple works, you may submit a representative list.
- Specific URL on Sceenz — the exact Sceenz.net URL(s) where the allegedly infringing material appears (for example, the link to the profile, bulletin, blog post, or image). General references to a username or area of the site are not sufficient — we need a direct link.
- Your contact information — your full name, mailing address, telephone number, and email address.
- Good-faith statement — a statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Accuracy and authority statement— a statement, made under penalty of perjury, that the information in your notification is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.
On receipt of a notice that substantially complies with the items above, we will act expeditiously to remove or disable access to the material and notify the user who posted it.
§ Counter-Notice Procedure
If you believe content you posted to Sceenz was removed or disabled as a result of mistake or misidentification, you may submit a counter-notice to our Designated Agent at legal@sceenz.net. A valid counter-notice must include:
- Your physical or electronic signature.
- Identification of the material that was removed or disabled and the URL at which it appeared before removal.
- A statement, made under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your full name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in the district where you reside (or, if you are outside the United States, any judicial district in which Sceenz may be found), and that you will accept service of process from the person who provided the original takedown notice or their agent.
We will forward valid counter-notices to the original complainant. If the complainant does not notify us within ten (10) business days that they have filed a court action seeking to restrain the activity, we may restore the removed material.
§ Repeat-Infringer Policy
It is Sceenz’s policy to permanently deactivate the accounts of users who, in our sole discretion, are determined to have repeatedly infringed the copyrights or other intellectual property rights of others.
We may also terminate an account at any time, without notice, in a single egregious case (for example, the upload of a complete commercial album or film). Account termination under this policy is permanent and the affected username may be retired.
§ Misrepresentations
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents either (a) that material is infringing, or (b) that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees, incurred by the alleged infringer, by any copyright owner or copyright owner’s authorized licensee, or by Sceenz, as a result of our reliance on the misrepresentation. Please consider these consequences before submitting a notice or counter-notice.
§ Changes to This Policy
We may update this policy from time to time. The “Last updated” date at the top of this page reflects the most recent change. Material changes will also be announced on Sceenz so users have notice.
