Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Sceenz.net and any related features we offer (the “Service”). By creating an account or otherwise using Sceenz, you agree to these Terms. If you don’t agree, please don’t use the Service.

§ Eligibility

You must be at least 13 years old to use Sceenz. If you live in the European Economic Area, the United Kingdom, or another jurisdiction that requires a higher minimum age for online services, you must meet that minimum (typically 16). If you are under 18, you confirm that a parent or legal guardian has approved your use of Sceenz.

Sceenz is not directed to children under the applicable minimum age, and we do not knowingly collect personal information from them. See our Privacy Policy for details.

§ Your Account

  • One personal account per person. Bands and artists may run a separate band account in addition.
  • Accurate info.Use a real email at signup and don’t impersonate another person, band, or organization.
  • You’re responsible for your account. Keep your password confidential. Anything done through your account is treated as done by you.
  • No account sales or transfers. You may not sell, lease, or transfer your account or username to anyone else.
  • We can intervene. We may suspend or terminate accounts that violate these Terms, are created with false info, or are otherwise used in a way that creates legal or operational risk.

§ Your Content

You keep ownership of everything you post on Sceenz — your bulletinz, blogz, photos, profile information, custom CSS, tour dates, merch entries, and any other content you submit (collectively, “Your Content”).

By posting Your Content, you grant Sceenz a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify (for technical reasons like resizing), display, perform, and distribute Your Content solely for the purpose of operating, providing, and improving the Service. This license ends when you delete Your Content or your account, except where we need to retain a copy briefly in backups or to comply with a legal obligation.

You represent and warrant that you have all rights necessary to post Your Content and grant the license above — meaning you either own it or have permission from whoever does, and that posting it doesn’t infringe anyone’s rights or break the law.

§ Acceptable Use

You may not use Sceenz to:

  • Post illegal content or facilitate illegal activity.
  • Harass, threaten, dox, stalk, or incite violence against any person or group.
  • Post hate speech or content targeting people based on race, ethnicity, national origin, religion, gender identity, sexual orientation, disability, or similar characteristics.
  • Post sexually explicit content involving minors. This is a crime, will be reported to the National Center for Missing and Exploited Children (NCMEC) as required by law, and will result in immediate, permanent account termination.
  • Impersonate another person, band, brand, or organization.
  • Send spam, chain messages, or unsolicited commercial messages, or use Sceenz primarily as an advertising channel for unrelated products.
  • Distribute malware, phishing links, fraudulent links, or anything designed to compromise other users or our systems.
  • Scrape, crawl, mine, or otherwise extract Sceenz data through automated means without our prior written permission. Reasonable manual use is fine.
  • Attempt to access accounts that aren’t yours, probe for security vulnerabilities outside a coordinated disclosure, or circumvent any technical restrictions.
  • Resell, sublicense, or commercially exploit the Service, its content, or any portion of it without our prior written permission.
  • Upload custom CSS, scripts, or other code that attempts to phish, deface, track, or otherwise harm other users. We sandbox profile CSS, but circumvention will result in account action.

We may review user content and remove anything we determine, in our sole discretion, violates these Terms or the spirit of the Service. We are not obligated to monitor content but reserve the right to do so.

We respect intellectual property rights. If you believe content on Sceenz infringes your copyright, please follow the procedure in our DMCA / Copyright Policy. Repeated infringement results in permanent account deactivation.

§ Premium Themes & Payments

Some features — currently premium profile themes — are paid. Payments are processed by Stripe; when you purchase, you also agree to Stripe’s end-user terms. We don’t store your full payment card details — Stripe handles those.

Refunds:Premium-theme purchases are generally final. If a paid feature stops working because of something we did wrong and we can’t fix it in a reasonable time, email legal@sceenz.net and we’ll consider a refund. You may also have statutory refund rights depending on where you live — those are not waived by these Terms.

We may add, change, or remove paid features over time. If we retire a paid feature you bought, we’ll either provide a comparable replacement, refund the unused portion, or both.

§ Third-Party Services

Sceenz embeds and links to third-party services — YouTube for featured tracks, Spotify / SoundCloud / Apple Music / Bandcamp / external merch stores via profile links, Stripe for payments, Ticketmaster for some tour data, and others. Those services have their own terms and privacy practices, and Sceenz isn’t responsible for them. Your use of third-party services is governed by their agreements with you, not these Terms.

§ Account Termination

By you: You may delete your account at any time from your account settings. Deletion cascades to your profile content. See our Privacy Policy for what we retain afterward and for how long.

By us:We may suspend or terminate your access to Sceenz, with or without notice, if (a) you violate these Terms, (b) we’re required to by law, (c) your account creates security or legal risk for us or other users, or (d) Sceenz is being discontinued. We’ll make reasonable efforts to give notice where possible.

Sections that by their nature should survive termination — including content licenses for material that you posted publicly before deletion, disclaimers, limitation of liability, indemnification, and governing law — will continue after your account ends.

§ Disclaimers

Sceenz is provided “as is” and “as available.”To the maximum extent permitted by law, we disclaim all warranties, express or implied — including merchantability, fitness for a particular purpose, non-infringement, accuracy, uninterrupted availability, and security. We don’t guarantee that Sceenz will meet your expectations, be free of errors or downtime, or preserve your content perfectly. Please back up anything you can’t afford to lose.

§ Limitation of Liability

To the maximum extent permitted by law, in no event will Sceenz, its operators, or its contributors be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages — including lost profits, lost data, lost content, or business interruption — arising out of or related to your use of or inability to use the Service, even if we’ve been advised of the possibility.

Our total aggregate liability to you for any and all claims arising out of or related to the Service or these Terms will not exceed the greater of (a) the total amount you paid Sceenz in the twelve (12) months immediately before the event giving rise to the claim, or (b) US $50.

Some jurisdictions don’t allow certain limitations of liability, so portions of this section may not apply to you.

§ Indemnification

You agree to defend, indemnify, and hold harmless Sceenz, its operators, and its contributors from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) Your Content, (b) your use of the Service, (c) your violation of these Terms, or (d) your violation of any rights of a third party.

§ Governing Law & Disputes

These Terms are governed by the laws of the State of Arizona, USA, without regard to conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Service will be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to personal jurisdiction there.

If you live in a jurisdiction whose laws give you mandatory rights to bring a claim in your local courts, this section doesn’t waive those rights.

§ Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent change. For material changes, we’ll provide reasonable notice on Sceenz before they take effect (we aim for at least 14 days). Continuing to use the Service after a change takes effect means you accept the updated Terms; if you don’t, please stop using Sceenz and, if you’d like, delete your account.
